Welcome to withflock.com, a website and service operated by Flock Solutions Inc. ("Flock", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your access to and use of our website, software development kits (SDKs), APIs, analytics dashboard, and other services we provide (collectively, the "Platform"). By using any part of the Platform, you agree to these Terms.

1. Use of Our Platform

You may only use the Platform in accordance with these Terms and applicable laws. You agree not to:

• Use the Platform for any unlawful or prohibited purpose
• Copy, modify, distribute, reverse-engineer, or attempt to extract source code from our SDKs or APIs
• Interfere with or disrupt the integrity or performance of the Platform

Access to the Platform may be revoked or limited at our discretion.

2. Account Registration

To access certain parts of the Platform, you may need to register for an account. You are responsible for maintaining the confidentiality of your credentials and any activity under your account.

3. Intellectual Property

All content, software, and technology made available through the Platform are the intellectual property of Flock or our licensors. You retain ownership of your own content and data, but grant us a license to use it as necessary to provide the service.

4. No Warranty

The Platform is provided "as is" and "as available" without warranty of any kind. We disclaim all warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose.

We don't guarantee that the Platform will be error-free, uninterrupted, or that data will be preserved without loss.

5. Limitation of Liability

To the maximum extent permitted by law, Flock is not liable for any indirect, incidental, special, or consequential damages (including lost profits, revenue, or data) arising out of or related to your use of the Platform.

6. Customer Responsibilities

You are solely responsible for:

• Ensuring compliance with applicable laws (e.g., privacy, tax, marketing regulations)
• Structuring your referral campaigns, incentives, and communications appropriately
• Managing fraud or abuse of your campaigns (though we may provide tools to help)

7. Third-Party Services

Our Platform may integrate with third-party services (e.g., Stripe, Tremendous). We're not responsible for their availability, functionality, or legal compliance.

8. Changes to the Terms

We may modify these Terms at any time. If we do, we'll update the "Last updated" date above. Continued use of the Platform means you accept the revised Terms.

9. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes will be resolved in the courts of Toronto, Ontario.
